TERMS& CONDITIONS
2. Subject of the Agreement:
The Subject-matter of this Contract is particularly the obligation of the Seller to deliver goods specified in Exhibit No.1 here to the Buyer and to transfer the property in goods to the Buyer under the terms and conditions herein and the obligation of the Buyer to accept the delivered goods from the Seller and to pay the agreed purchase price.
3. Sale of Goods:
A. The Seller hereby agrees to deliver the Buyer goods specified in Exhibit No. 1 hereto and in the time, quality and quantity specified in Exhibit No. 1 hereto. The Buyer shall accept the Goods and pay Seller for Goods the purchase price stipulated by the Seller.
4. Title of Goods:
The title in the Goods shall pass to Buyer immediately upon delivery of Goods to the Buyer’s. Risk of damage to or loss of the Goods shall pass to the Buyer at the time of delivery.
5. Purchase Price:
A. The Buyer shall pay the Seller the purchase price of the goods amounting as per the purchase price stipulated by the Proforma Invoice or Invoice (hereinafter referred to as the Purchase Price).
B. The Purchase Price shall be due upon the Proforma Invoice or Invoice issued by the Seller as per Payment Schedule made on the day of this agreement and as stated at the tail of this agreement.
6.: Project:
The Seller is to conduct the installation of all the Goods specified in Exhibit No. 1.
The installation of all the Goods will be made in a timely manner. The work is estimated to last between two to three weeks from the start of the installation, some bespoke items might require adjustments and can potentially take a little longer to install.
The installation (excluding Dry Fit) includes the fitting of all the Goods to be made ready for use, to conduct any potential carpentry work such as partition wall necessary for the Goods to be installed.
Tiling: Floors and walls for the rooms agreed upon and whereas the Goods listed in Exhibit No. 1.
Plumbing:
A- Bathrooms: Connection to pre installed feed of any shower mixer and wash basin mixer, connection to waste for shower and washbasin, connection between shower mixer and shower heads, connection of wc’s and waste to existing plumbing.
B- Kitchens: Connection to pre installed feed for sink, tap, dishwasher, washing machine, coffee machine, steam oven, and fridge freezer with water dispenser to existing plumbing.
Decorating/painting: Walls and ceiling to be painted on the rooms previously agreed upon and where the Goods specified in Exhibit No. 1 are to be installed.
No agreement has been made between the two parties in regards to the installation of any internal doors, instead the installation of these doors will be made by the Buyer’s carpenter.
B. The Seller shall deliver the Goods to Buyer’s carrier during regular business hours. Seller shall notify Buyer regarding the delivery of Goods by carrier. If Goods are items ordered from the Seller by the Buyer and the manufacturer delays the delivery beyond the stipulated delivery date, then the Seller will do their level best to speed up the delivery and at the same time the Seller cannot be held accountable for these delays.
7. Product Liability:
The Seller shall be liable for any lack of conformity in Goods as per under the Article 26 from EU Consumers Right Directives in the House of Parliament and on remedies for lack of conformity.
(hereinafter referred to as the Warranty Period).
8. Arbitration Clause:
Any claim, matter or controversy arising out of or relating to this Agreement, or the breach thereof, shall be decided by arbitration in accordance with the Arbitration Act, 1996. The Venue of Arbitration shall be Greater London.
9. Liability
A- The Seller will not be liable for the checklist ticked below by the Buyer. This checklist confirms that the Buyer was made well aware of the Design Specs, Delivery Schedules and Conditions:
⌗ Design Layout and Dimensions as Per Exhibit 1.
⌗ Materials and Finishes as Per Exhibit 1.
⌗ Delays in delivery beyond the control of the Seller.
⌗ Any joint lines on the Splashback and/or Work Surface.
⌗ Grout Colour.
⌗ Any claims for faulty materials supplied are void once they are fitted/installed.
⌗ All products should be checked and reported within 48 hours after being delivered, it is the buyers responsibility to check the good condition of the goods once delivered.
⌗ Warranty Period for appliances must be registered online by Buyer once installed.
⌗ Any variations stipulated by the Buyer beyond the Exhibit No. 1 will incur extra charges subject to mutual agreement.
⌗ Seller is not the manufacturer of appliances, the Buyer must follow up on any malfunctionality directly with the manufacturer.
⌗ Seller will only conduct one rubbish removal at end of Goods. Any extra rubbish collections to be paid by Buyer.
⌗ The Seller communicates with the Buyer, not with a builder on sight.
⌗ Either of the Builder, Plumber, or Electrician can only liase for the gas/plumbing feed and electric points with us not with our fitting team.
⌗ We will deliver to the room of your choice as long as there is no health and safety risk to our delivery team relating to access to that room or if any damage might be caused to your property (e.g. narrow staircase, hallways, doors, loose flooring, etc... ). We ask you to kindly make sufficient DRY space in your property for us to properly deliver your order.
⌗ If the space is a work in progress like a building site, the Seller will cover the Goods once installed with dust sheets (Excluding Bathrooms). The Seller will not put tape on the goods and will not be held liable for any residual tape marks that may damage the Goods.
Cancellation/Refund
You are legally entitled to cancel an order up to 14 days from the ordering date.
Each model is manufactured to order, so there is no return nor refund policy once the manufacturing process has started ( which will be after the initial 14 day 'cooling off' period ).
